Cognata Privacy Policy

This Privacy Policy describes how, we along with our affiliates (collectively referred to as “Cognata”, “we”, “us” or “our”) collect, store, use and disclose (collectively, “Process”) Personal Information that we obtain when we provide services and products to our customers, or manage our business and other relationships, or when you use our websites, mobile applications, newsletters, or otherwise when we communicate with each other (collectively, the “Services”).  Throughout this Privacy Policy, “Personal Information” means information that identifies an individual or may - with reasonable effort - identify an individual. 

This Privacy Policy only applies when we Process Personal Information for our behalf (i.e., as controller), and it does not apply to any information which we may process on behalf of our customers or any third party. Such information will be subject to the customer's or that other third party’s privacy policies, as applicable.

You acknowledge and agree that your Personal Information may be Processed in accordance with this Privacy Policy and that your failure to provide requested Personal Information may prevent us from performing certain Services (e.g., use of the Cognata Simulation Platform may require you to provide us with your business email address. If you fail to provide us such information you will not be able to use the Cognata Simulation Platform).

  1. Information We Collect
    We collect Personal Information either directly from you, or from third parties (such as your company which may provide us with your email address). Below is a non-exclusive description of the different types of Personal Information we process and the sources from which we obtain them:
  • When you interact with us, for example, by registering to our newsletter, we collect information that identifies you. This may include your name, company name (or other affiliation), email address, telephone number and job title. This may also include other information such as your areas of interest. 
  • When you or your company (or any other entity with which you are affiliated) receive a right to use our software products and services (“Our Products”) based on Single Sign On (SSO) right, and you and your company provides us with your email address so as to enable you to use the Single Sign On right, then we may collect your Personal Information such as your email address, the name of the company for which you work, or the name of the university where you teach or study, information about support calls you made, as well as any other information which is necessary to create, administer the SSO account and deliver the Service we agreed to provide.
  • Some information is also automatically collected when you use cloud services or websites, such as your Internet Protocol (IP) address. We treat this information as personal information if we combine it with or link it to any of the identifying Personal Information mentioned above. 
  • We may also obtain Personal Information about you also from our business partners and vendors who will provide us with your Personal Information to enable you to use our Services or to use products which we license. This may include: your name, your company (or other affiliation) and email address.
  • We may collect Personal Information to enable us to engage in transactions with customers, suppliers and business partners and to process orders for our products and services.
  • We may collect Personal Information to comply with applicable laws and regulations and to operate our business.
  • We may collect site use data for security and operations management to help keep our sites, facilities, networks and systems secure, or to investigate and prevent potential fraud, including fraud and cyber-attacks and to detect bots.

  • to provide you with Our Products, the Services;
  • to create and administer your SSO account and provide corresponding Services; 
  • to help keep our sites, facilities, networks and systems secure;

  • to comply with applicable law.

    We may share your Personal Information in the manner and for the purposes described below:
  • Execution of a Contract. We need your Personal Information to provide you with our Services or in order to take steps to enter into a contract with you.
  • Compliance with a Legal obligation. We are required or allowed to collect and use your Personal Information, for example, to detect fraud.
  • Legitimate interest. We or a third party, have a legitimate interest in processing your Personal Information. For example, we may collect your Personal Information in order to communicate with you and present you with marketing materials and opportunities regarding Our Products and Services.
  • Consent. You have consented to the use of your Personal Information, for example, to send you newsletters or for the use of certain cookies.

Through the use of cookies and similar technologies, we may collect your device IP address, unique device ID, hardware and software type, Internet service provider, serving domain, geographical area, location data, browser type, and settings data (such as screen resolution, color depth, time zone settings, browser extension and plugins) operating system, referring URLs, search history, information on actions taken or interaction with our digital assets (e.g., page views) and dates and times of actions. We use this information to create reports and improve our Services. The cookies help us understand the number of visitors to our website and where visitors come from.

Depending on applicable law, you may have some rights and choices with respect to your Personal Information. These include:

    • Request access to and receive information about the Personal Information we maintain about you, update and correct inaccuracies in your Personal Information, have the information deleted, or exercise your right to data portability to easily transfer your Personal Information to another company. 
    • Where we rely upon legitimate interest to process your Personal Information, then you have the right to object that processing if you believe your fundamental rights and freedoms outweigh our legitimate interests. If you raise an objection, we have an opportunity to demonstrate that we have legitimate interests which override your rights and freedoms. 
    • Lodge a complaint with a supervisory authority, including in your country of residence, place of work or where an incident took place.
    • Withdraw any consent you previously provided to us regarding the processing of your Personal Information, at any time and free of charge. We will apply your preferences going forward and this will not affect the lawfulness of the processing before your consent withdrawal.

If you wish to access any of the above-mentioned rights, we may ask you for additional information to confirm your identity and for security purposes, in particular before disclosing Personal Information to you. We reserve the right to charge a fee where permitted by law, for instance, if your request is manifestly unfounded or excessive. You can exercise your rights by contacting us. Please note: We may not always be able to fully address your request, for example, if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way.

6. International Data Transfers
We operate on a global basis. Accordingly, your Personal Information may be transferred and stored in countries that do not have the same data protection laws as the country in which you initially provided the information. 

7. Links to Other Websites
This website may link to websites maintained by outside organizations, including third-party social networks (such as Google+, Facebook, Twitter, LinkedIn). Please be aware that these third-party websites are governed by their own privacy policies. We are not responsible for the content or policies maintained by these websites. 

8. Security
We maintain various safeguards that are intended to appropriately protect Personal Information against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of the Personal Information in our possession. However, because no information system can be 100% secure, we cannot guarantee the absolute security of your information.

9. Data Retention
We take measures to delete your Personal Information or keep it in a form that does not permit identifying you when this information is no longer necessary for the purposes for which we process it unless we are required by law to keep this information for a longer period.

We reserve the right may make changes to this Privacy Policy. Changes to this Privacy Policy are effective when they are posted on this page.
